These Terms of Service ("Terms") govern your use of the website located at [selffund.com] and the online tools, forms, and platform access made available through it (collectively, the "Services"), operated by Self Fund Platforms, Inc. ("Self Fund," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Separate Agreements
The Services are intended for business users. Bid engagements and platform use by employers, advisors, and vendors are governed by separate written agreements with Self Fund. If a signed agreement with Self Fund conflicts with these Terms, the signed agreement controls.
2. Informational Purposes Only; Not Professional Advice
The content on the Services, including information about self funded health plans, plan vendors, contract terms, fiduciary duties, and laws and regulations, is provided for general informational purposes only. It is not legal, tax, accounting, actuarial, or other professional advice.
Template letters, checklists, and other tools made available through the Services are general forms. They are not tailored to your situation. Consult your own counsel and advisors before relying on them.
Decisions about a health plan and its vendors remain with the plan sponsor and its advisors. [Use of the Services does not make Self Fund a fiduciary of any health plan.]
3. No Guarantee of Results
Statistics, examples, benchmarks, and savings estimates on the Services are provided for general information. They are not a promise or prediction of results for any employer or health plan. Actual outcomes depend on many factors, including the covered population, plan design, claims experience, and the vendors that choose to respond.
Bids and proposals are prepared by the vendors that submit them. Self Fund does not guarantee the accuracy or completeness of any vendor's bid or the future performance of any vendor.
4. Insurance Licensing
[Self Fund Platforms, Inc. is licensed as an insurance producer in Illinois. Nothing on the Services is an offer to sell, or a solicitation to buy, insurance in any state where Self Fund is not licensed.]
5. Accounts
If you are given an account, you are responsible for keeping your login credentials confidential and for activity under your account. You confirm that you are authorized to act for the organization you represent and that the information you provide is accurate. Tell us promptly if you believe your account has been used without your permission.
6. Information You Submit
You confirm that you have the right to submit the information you provide through the Services, and you permit Self Fund to use it to provide the Services as described in our Privacy Policy and any signed agreement.
Do not submit Protected Health Information through the Services unless Self Fund has confirmed in writing that a Business Associate Agreement is in place, and then only through the method Self Fund designates.
7. Privacy
Our collection and use of information through the Services is described in our Privacy Policy and HIPAA Notice, which are incorporated into these Terms by reference.
8. Intellectual Property
The Services and their content, including text, graphics, logos, software, and design, are owned by Self Fund or its licensors and are protected by intellectual property laws. You may view and print content for your internal business use. You may not copy, modify, distribute, or use the content for any other purpose without our prior written permission. Self Fund's names and logos may not be used without our permission.
9. Acceptable Use
You agree not to use the Services in any unlawful way, attempt to gain unauthorized access to the Services or their systems, interfere with their operation, or use automated means to collect content from them without our permission. You agree not to use the Services to obtain another party's confidential information or to share or coordinate bid information with competing vendors.
10. Third Party Links
The Services may link to websites and materials published by third parties. These links are provided for convenience. Self Fund does not control and is not responsible for the content, accuracy, or privacy practices of any third party site.
11. Disclaimer of Warranties
THE SERVICES AND THEIR CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NONINFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SELF FUND WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
13. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law rules. Any dispute relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Lake County, Illinois.
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Services after changes are posted means you accept the updated Terms.
